Find answers to your legal question.

I am a illegal immigrant. Iam engaged to a U.S citizen. Will i be able to reside in the US after i get marrie?

I am aware of the K-1 visa. From what i know you could only apply for it before entering the US. What are the chances of still obtaing a visa if your enaged to a US citizen but you are already in the US illegally?

DIS CHICK
yes if you get married to a citizen then you can become a citizen without having to go back to your country

but there are other requirements, like having a job

Ms.
nope..you have to enter the country legally first.. so you still must go back to your home country and apply for a visa before you are able to stay lawfully :0)

In what way are you an illegal immigrant? If you entered without inspection, after marriage your wife can petition for a visa for you
(Form I-130) but you must obtain an immigrant visa at a US embassy or consulate outside the US. If you entered lawfully but are only in violation of status, after marriage you can file for adjustment of
status on form I-485 concurrently with the I-130. For the forms and
instructions see uscis.gov.

It all matters on whether you entered legally or not. If you entered legally then your husband should be able to petition for you and everything will be fine. But if you entered illegally then you don't have a chance. You must exit the US as soon as possible and have him petition for you that way. Good Luck

You can't do anything if you're engaged, as you wouldn't be eligible for a K-1 visa even if you return to your home country. After your marriage, your spouse can sponsor you for residency.

If you entered the country on a valid visa which has since expired, you are eligible to adjust your status within the US.

If you entered the country illegally, you will have to return to your home country for Consular processing. There is no way around this. You will be denied at the interview due to your illegal presence in the US and the resulting entry bar, but your spouse can then file an I-601 waiver. If they are able to prove extreme hardship to him/herself should your petition be denied, your bar will be forgiven and you will be able to return to the US as a conditional permanent resident.

I would recommend using a reputable immigration attorney for the waiver process. It's far too important to leave to chance.

The best thing to do is as soon as you get married get a lawyer
.
Do not go on your own and tell that you are here illegally
.
That would make the person that you tell it to take you in custody
(Hand cuffs)
on the spot
.
A lawyer will go thew the court and tell you all you have have have to do
,
It will be frightening to say the least but the court has to look at why you got into this country and what you have done since you have been here to support your self
.
So if you have hand any type of employment that person might be in a little trouble having you work for them if they have to have a proof of citizenship that is to work there
.
Other wise it is going to take time and you might be able to stay with your new wife under restrictions of travel
.
But in the end it is to teach you a lesson that to do something that is not legal will be handled justly
.
Cause if you were received with open arms think what that would do for people wanting to get into this country in such a manor
.
Reading in the news paper or the phone book something like
.
Marry today become a citizen tomorrow and divorce next week to become a citizen of America business
.
in the yellow pages of the phone books

Yes you will. Once you are married, your husband will be able to sponsor you. You are lucky to be already in the US. It does not matter anymore that you are an illegal immigrant once you get married and apply for your papers. You will immediately be able to adjust your status. Keep your I-94. You will be surrendering it, once you and your husband will be interviewed. Good luck!

NO

you really need to go home and have your wife apply for you legally.

you cannot change your status from illegal to legal while you are still INSIDE USA.

you have to become a citizen first. you should have done that in teh first place. makes everybodys life alot easier
