She is illegal but her child is a legal US citizen and by the law US government is responsible for her. I know that so many racist americans will not going to agree but this is a law - US law. If you dont like it call to congress and let them know but so far that small girl has the same rights as me and other americans.
I dont really know where she should be looking for support but i wish good luck and welcome to US nation - immigrant nation.

I applaud u for helping them out. Especially in your condition I think Jan is right. Bringing attention to her status as being an illegal immigrant may get her deported. I think she should go home if only to renew her visa and come back and apply for citizenship. She needs to do things LEGALLY. The consequences could be very sad and she doesn't want to never be allowed back here in the states. Especially have a child that is a US citizen. There are so many resources that you can contact about this matter to get free legal advice for her. Just in case NOT one of these answers is legally correct. She REALLY should be demanding child support from the father of her child. She probably cant do that because he would report her as being illegal.

BUT if you want to avoid getting as criminal record then you really need to KICK HER OUT.

I think you described the situation incorrectly. If she is a refugee, she needs to get a job. But it doesn't sound like she is a refugee. If she is committing a crime by overstaying a visa, she needs to correct that by self deporting. If she is lucky, homeland security won't find out, and won't ban her from entry, and she can apply for a visa from home legally.

has she registered her baby with the births, deaths and marriage department? her baby, because born on usa soil, is by rights and american...i dont know what will happen though when govt find out she illegal immigrant..prob grant status now it's under obama, she needs to get a lawyer...they can help with this...where is the father of the baby? is he american? The government will want to find the father...usa is big on making guys pay for the child support and will want to track him down.

Make sure she gets child support from her baby's father before doing so. She could probably live very well in her own country on it.

Children of parents that are illegal get help from social services that's just another reason our national taxes are so darn high people come here and milk the system.
GO AHEAD BUT when i can't afford my propeety taxes i know why.
even our schools are crumbling from the weight i was for helping but now after i see what a rip off the foreigners are doing the Govt should start deporting some of these people.

The next phrase used was 'girlfriend'. Does that mean she is a friend who happens to be female, or she is your domestic partner equivalent to a husband ?

I don't think your friend can get support, but I believe the father can if he has the responsibility of looking after the child and is a citizen. She is in a bit of a pickle with her paperwork - she may have to go back to her country of origin and then request another visa, but she may not be able to take her baby with her without the father's permission.

I am not sure how closely your situation resembles mine, but this is how it works in the UK.

My wife is from overseas and has a valid indefinite leave to remain visa, which allows her to stay here but not put in claims for benefits of any kind. She has a daughter, my stepdaughter, who was also born overseas and has a valid indefinite leave to remain visa.

I am working and pay tax by the bucket load. I am also responsible for the well being of my stepdaughter, as I am for the son from our marriage. Effectively I am getting a small tax refund to give a hand looking after the kids. Although I am not related to my stepdaughter as a blood relation, we are related through marriage. Her mother cannot claim, but I can.

I think the same will apply to you - I am a British citizen, paying taxes, and responsible for two children although one is a stepdaughter from overseas, the other my genetic son. I have the same rights for both of them by virtue of my citizenship, but my wife hasn't until her final citizenship papers are cleared.

If she came here on a visiting visa and didn't return,she is not a refugee,she is an illegal alien.
Ask the father to support his child,not the taxpayers. It is his responsibility.
The way our messed up laws are,the child is a citizen even though the parent is here illegally. So,the child is legally entitled to taxpayer money. She can apply,but will have to name the father and he will have to pay child support.
She is subject to deportation if caught. Applying for assistance might bring attention to her illegal status. Having a child here will not prevent her being deported.
It is people like this that give immigrants a bad name. They come here,ignore our immigration laws and then want us to support them and their children.
