Yes he can be deported, but if he has lawyer why didn't the lawyer file a waiver for him. If he was caught with someones Else's papers then he was deported and he can not enter for 10 years legally If he entered the U.S illegally and was here illegally or legally he is still subject to deportation, even if he is married to a U.S Citizen. She can file for divorce or go with him to Mexico.

He broke the law when he entered this country illegally, he then used false documentation. He is a common criminal. He should get deported.

If he is here legally on a visa now, the stipulation on that is if he breaks a law, he will immediately be deported.

If the record shows that he at one time was caught breaking the law, then he obtained his visa falsely (you can't have ever broken an American law to get one). This is a question they ask, and it is stipulated in the entire procedure. Not admitting to identity theft (which is what he did), when he had been caught at it was him being deceptive. And according to the laws, that is a deportable offense.

It is unfortunate that he is married to a citizen, and has a family. But that is the law. The entire thing happened before he married, and I am sure they are looking at that as everything after is a "fraud". It is unfortunate, but it is the law.

Mostly likely he is not legal. Even if he is married to an American citizen - it could take years til he gets his papers. So yeah he could get deported.

He isnt a citizen just b/c he gets married. There are still papers that have to be filled out and time spent back in your own country. He should be arrested b/c he broke the law!

I doubt it was exactly like that. Unless he is lying about being a citizen. The only times I've heard of that being revoked is if someone obtained it fraudulently (like really they were a drug runner but said they were someone else).

If he is illegally here, of course, he can be deported.

typical lies, typical Mexican, typical situation that you bleeding hearts always get into, no reasoning, no thought or think above your ears. hope they send him away and he can't get back in ever, better yet is send his ole lady and kids with him. take out all the trash at one time and be done with it.

This is possible. He could also be barred from being in the US for ten years. It doesn't matter if he's married to an American citizen, unless he can prove that she's dependent and needs him for major support such as financial or medical reasons. In that case, then he'll have trouble gaining citizenship as well because she has to prove she can support him for his application to be approved. (The gov't wants to ensure that they won't be taking a charity cause and be supporting him through welfare and such.) Sound contradicting? It is.
