I have an urgent question about immigration!?

hi, here is the situation. my father is currently in immigration jail. The thing is that my father committed a felony crime in which he had to serve 8 years in jail. now that his sentence is up, he got detained by the immigration officials. He is now held as a detainee in the immigration jail. my father has a green card though. Last week he was given a choice of either signing a paperwork stating he will go back to his country or hiring a lawyer, in which he will be up against the immigration people. my father really wants to stay in USA, since all his family members are in United states. Now my family and I are confused because we really dont know if we should either hire a lawyer representing him or should he just go ahead and sign the paper work stating him to go back to his country. my mom, my sister and I are all US citizen, so if he goes to the trial, what are the chances of him winning the case against the US immigration and staying in United States? will he have better chance if he hires a lawyer instead and fight by his side? i really need professional answer at the moment..

You can usually contact a lawyer and ask him what you are asking us here. He will give you the odds and you can decide if you want to retain his services or not. Normally, this consulation will not cost you anything. If you do run into fees and you can't afford it, try legal aid. |

You can waste your money on a lawyer if you want,but I highly doubt it will do any good.
He committed a felony,one that got him 8 years in jail. His green card is gone and he is no longer welcome in the US.
Having a family here will not help him. He will be deported,probably with a lifetime ban on returning. |

He WILL NOT win in court.
His 'green card' became invalid the day he committed a felony.
It's common for illegals in jail to be detained by ICE or the U.S. Marshals after finishing their sentence to be deported back to where they came from.
Additionally, he will not be allowed to EVER come back to the US.
And that is how it should be. |

The truth of the matter is...
He is going to have to leave the USA
one way or the other...
He is not a US Citizen...and can never become
one since he has a Felony Criminal record...
They are not going to release him back onto
the streets of the USA...they will escort him to
Border or fly him to his home Country under escort.
He either goes now...
or wait for years behind bars while he fights it...
Best check your Mothers immigration Status also... |

First of all it depends what kind of felony> Under immigration law there is a category of felonies that no lawyer can help and he would be deported anyway and his green card revoked and on top of it he won'tbe able to return to US ever. So I recommend a consultation with a deportation lawyer to see how big is your dad's chance to stay here. Also if he decides to fight the case it can be a long process up to year or more. I am sure by now his green card has been confiscated due to his jail time for being a felon. An attorney may help him stay in this country, but I seriously doubt he will do any good considering your father's criminal activity. Sorry. |
