If you are in USA - 3 years if you are married to a US citizen, and 5 years if you are NOT married to a US citizen.

If you are in Canada - 3 years from the day of landing - which would be May 2010.

You have to be in the United States for 5 years before you can apply. That does not mean 5 years without leaving for vacation or visiting your country of Origin. You must return from vacation or your country in 5 months maximum. You can apply for an extension from immigration before you leave. Extension would be granted for serious illness of your Mother, Father, Wife, Child or yourself.
