I know someone that came here legally and was even married for a few years. They're in the middle of a divorce now. My question is, what does he need to do and what steps does he need to take in order to become legal (his Visa expired). About how long would the process take and how much would it cost? Thanks SO much for your answers!

You say there's nothing he could do? Could he marry his American girlfriend? Would there be any options then?

There's nothing that he can do from within the US. He has to return to his country of origin and apply for another visa from there. He's going to have trouble though because he already overstayed his current visa and the consular officer is going to take that into consideration. And he should do it before he gets deported. Deportation and overstaying a visa is two and a half strikes against you in the process.
EDIT: Marrying an American citizen changes nothing. He still has to return to his country of origin to begin the process. By law, it can't be done here. |

well the best thing to do would be to leave now, before they catch it. Then, reapply from the home country. Or the person could sit around and be forced to leave in handcuffs, they will take fingerprints and retina scan and then the only way back in would be to sneak over the Mexican border with the rest of the freeloaders |
