My spouse has a CR1 Visa status. The USCIS was supposed to send us a notice to apply. We never recieved a notice. My spouses Green Card is expiring this week. What should I do?

On your welcome letter it states that you will NOT receive notice to file the I-751. You are just supposed to keep track of it yourself. Print out the I-751, fill it out, include as much paperwork as you can get together today and have it overnighted tomorrow. Once they receive it, you will get a letter with an automatic one year green card extension. I know it's very short notice to put together an I-751 packet, BUT, you MUST do it before it is expired. Include the most important things, joint tax returns, joint bank accounts and so on and get it in fast. It only takes them a couple days to mark it as received, if you get it out tomorrow and overnight it, it should get there before the deadline.
Unfortunately you probably do not have time to put together a very complete packet. Include as much as you can and get it there. If the most important stuff is there, hopefully you'll just get a request for more evidence but at least your spouses status will stay current.
Do whatever you have to- stay up all night working on it if you must, but get it out or risk loosing your spouses status. "I forgot" is not a good excuse by USCIS standards for late filing. |
