Will the local police in New Jersey assist me in his rightful deportation or do I have to take him to a different agency. I know for a fact that he is illegal and I want him removed from this society where he has no rights under our constitution. I personally believe we as citizens should all be doing our part and making citizens arrests on illegals because democrat or republican our Govt. has shown they wont do nothing about our huge illegal alien problems. The immigration law that requires that aliens be documented for legal entry. Those who sneak intto the country are referred to as "entry without inspection" (EWI). Others enter with legal documentation and then violate the terms on which they have been admitted by taking jobs that are not authorized or overstaying the authorized period of stay in the country. It is my belief that a citizen's arrest is legal only for felony acts. Before carrying out this action, I would call immigration to determine if INS will investigate the matter. |

YOU will be the one arrested if you do this. YOU can NOT detain someone, as a citizen arrest, unless that person has committed a FELONY. Even then, YOU can still get in some major legal issues.

Contact your local police department and ask them. I am sure they will tell you the same thing. Or contact Customs/Immigration.

While our laws allow for a citizen to "arrest" someone, it is very limited in what can be done, and puts the arrestee in some danger of legal retribution. You cannot detain anyone you believe breaking the law, as that is a form of illegal detention in itself. You alos cannot keep the person you arrest from just plain leaving the scene. If you wish, in this case, to turn someone in as an illegal immigrant, contact the FBI or the local immigration office and report this person. Don't get carried away by videos of Dog the Bounty Hunter and take this into your own hands. It will only backfire against you if you detain, or even so much as lay hands on an individual. Let government representatives handle this.

I dont suggest transporting, that could be considered kidnapping or unlawful imprisonment. Do some extensive research of state and federal laws before making this arrest, you might also want to contact the local authorities beforehand in order to have them on alert so that you get a quick response.

Making a citizens arrest could be a very dangerous thing to do. If you feel so strongly about this person, then I would contact INS and report the person as an illegal. Then, I would leave the persons fate up to them. |
