Find answers to your legal question.

I see from previous post most like the Minutemen-if push came to shove-would you arm them?

Would you say ok-if our goverment will not do anything? And things get worst and worst.

Before you guys start bashing the Minutemen you should at least educate yourself about their goals and strict guidelines. I support them 100%. They are a non-violent bunch of dedicated Americans who are giving their time and effort to secure a border that the government wouldn't. They are NOT thugs or vigilantes. It is not their plan of operation to strong-arm anyone. Simply observe and report to Border Patrol. They are building fence with their own time and money. To answer the question: I don't think the MM would allows themselves to be armed for violence. Just self protection.

For those of you who are bashing them... I wonder what YOU are doing to help your country?

Most carry as a self-defense precaution in case they are attacked by the coyotes. They are doing what every neighborhood watch program in this country does, if they see a criminal they call the authorities to apprehend the criminals.

The government doesn't persecute citizens, the government may prosecute. There is nothing the government could PROSECUTE the Minute Men with, they are abiding the law, legally putting fences on private property.

A real American doesn't rely on the government to do what is necessary (other than we don't act as executioners) to fill a gap in society.

It's a shame people who have no idea what they are talking about try to impose their uneducated ideas down everyone throat

Mendi8a
No. I would not support the Minute Men in any way. I would definitely not let them have weapons! I would hope that the government would persecute them to the full extent of the law if they tried to hurt anyone.

sqwirlsgirl
In a "dreamy" world.......there are lots of groups who would like to be armed.

This group is in the spotlight BECAUSE.......this issue is. I may be wrong.......Lord I hope I am......BUT.....if ANYONE condones arming a group who has taken the law into their own hands (WOW)......well......that is HISTORIC and by HISTORIC I mean.....you live in the past and hope it recreates the future.

Do I need to rant about LAWS, our LAWMAKERS, our VOTE.

If you aren't happy VOTE correctly........that is the AMERICAN way......period.

Peace

Definitely! I have even much greater respect for the minutemen than I ever did in the past realizing they're there to protect our country, a country that's supposed to be a safe haven.

I say they should be completely armed, loaded and ready to attack any illegal criminals that tries to sneak into the US without permission!

Hmm, we should establish a new national holiday called, "The Minutemen Day"! =)

Yes, I would arm them, but ensure they are trained properly. You can bet many of the illegals coming over the border are armed and it is only fair that the Minutemen be armed too, if only for their own protection.

hayleylov
yes if they went through training to do so but so far all they do is assist the border patrol and build fences

come on barbara i saw them on tv last week saying they hated white people and the good white person is a dead person no minutemen are talking hate like this they just want the boder protected

They all have arms and probably more accurate than G.I. But to answer your Question YES

If need be, yes they should be armed. This country is at war with Mexico and it's time Americans wake up to the fact. The Mexicans are invading with massive illegal immigration. They are not here for peace. They want to take over parts of the U.S.

If push come to shove, sure would.

They already are armed for self-defense. Not everyone coming across that border is a migrant worker.

I'd really rather have the trained border patrol doing the job once it is expanded, though. I'm sure someone is going to create an incident if only to draw the Minutemen into something if it goes on too long.

However, the government needs to do its job.

legalboi65
I would.

dowdee@sbcglobal.net
I see what they are trying to do. If there ancestors (the Minuteman's) had to come in the legal way, So should the people jumping their borders. But I hear that they are a hateful bunch of people who believe that only the whites are allowed in the USA. I don't know if it is true but if it were then no. and even so all they really have to do is alert the real law enforcers (police, state troopers, etc) not take the law into their own hands. we don't want the KKK thing all over again. Peace people please! We are not at war with Mexico, those people just want to get a better life for themselves and family just like all our families, (example : the Irish immigrant who left because of the potato famine, or those leaving England because of some reason or other all over the world) it is the same
thing! But if the goverment didnt do anything I will not give them weapons but I will support like bringing food and water, or something.

ZZZZZZZZZZZZZZZZZZ!!!!!!!!!!!!!

ARM THEM NOW, only after training them....We as a country, are to "nice" to everybody............

they don't need to be 'armed' by anybody. They can get the weapons legally - as long as they are registered and don't fall into the categories of people not allowed to carry weapons (such as felons, illegal aliens, people dishonorably discharged from the military, people who have renounced their US citizenship, etc..)

Today, only two states--Wisconsin and Illinois--flatly refuse to allow people to carry guns for protection against criminals and that is being contested.

So the minutemen can, if they feel their safety is threatened carry weapons - it is the law.

It is a right granted to us by our founding fathers in the 2nd Amendment of the Constitution, see following:
The Second Amendment

The Second Amendment guarantees: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

This guarantees a citizen's right to keep and bear arms for personal defense. The revolutionary experience caused our forebears to address a second concern -- the ability of Americans to maintain a citizen militia. The Founding Fathers trusted an armed citizenry as the best safeguard against the possibility of a tyrannical government.

James Madison, author of the Second Amendment, wrote that Americans had "the advantage of being armed," that was lacking in other nations, where "the governments are afraid to trust the people with arms." Patrick Henry proclaimed the "great object is that every man be armed. . . . Everyone who is able may have a gun." The Second Amendment was then, as it is today, about freedom and the means to protect it.

In United States v. Miller, 307 U.S. 174 (1939), the Supreme Court refused to take judicial notice that a short-barreled shotgun was useful for militia purposes. Nowhere did the court hold that an individual does not have a right to keep and bear arms. In United States v. Gomez, 81 F.3d 846, 850 n. 7 (9th Cir. 1996), Judge Kozinski opined that "The Second Amendment embodies the right to defend oneself and one’s home against physical attack." In United States v. Hutzell, 217 F.3d 966, 969 (8th Cir. 2000), the court held that "... an individual's right to bear arms is constitutionally protected, see United States v. Miller ...." In United States v. Emerson, 270 F.3d 203 (5th Cir. 2001), the court examined United States v. Miller and held: "We reject the collective rights and sophisticated collective rights models for interpreting the Second Amendment. We hold, consistent with Miller, that it protects the right of individuals ... to privately possess and bear their own firearms ...."

The U. S. Supreme Court has recently recognized the Second Amendment as an important individual right. Planned Parenthood v. Casey, 505 U.S. 833 (1992); United States v. Verdugo-Urquidez, 494 U.S. 259 (1991).

On December 17, 2004, the U.S. Department of Justice published an exhaustive Second Amendment memorandum. It concludes without reservation that "the Second Amendment secures a personal right of individuals, not a collective right that may only be invoked by a State or a quasi-collective right restricted to those persons who serve in organized militia units." http://www.usdoj.gov/olc/2004opinions.htm

The Founding Fathers distrusted a government that wouldn't trust its people. To fulfill the promise of the Declaration of Independence, the authors of the U.S. Constitution and its Bill of Rights made it clear that individual rights were paramount. The Bill of Rights, wrote Madison, was "calculated to secure the personal rights of the people."

Some claim that banning only certain firearms does not constitute an infringement of Second Amendment rights. That measured ploy is not new. George Mason exposed it at Virginia's constitutional convention in 1788: "[W]hen the resolution of enslaving America was formed in Great Britain, the British Parliament was advised by an artful man . . . to disarm the people; that it was the best and most effectual way to enslave them; but that they should not do it openly, but weaken them, and let them sink gradually."

Our founders risked their lives to create a free nation, and they guaranteed freedom as the birthright of American citizens through the Bill of Rights. The Second Amendment remains the first right among equals, because it is the one we turn to when all else fails.

You can research more on this if you want on many sites, including the NRA (
