Today my wife and i had interview for i 130 evrything went very well , i show them every evidence and we got approved
more info about my case : i fille only i 130 and i live in usa overstayed since 2005
got married last year , ice came get me because overstayed . i stayed in center for 3 weeks , i bond out after 2 hearing my i 130 approve and i am going to see judge on august
i have some few question that i wanna ask;
1 how long take for i 130 to receive in mail
2 can i get work permit
3 what the next step so i can get my green card
4 do i need second interview for adjustement

WHAT!?!?!? the ICE went looking for you because you over stayed...??? and you went to jail??? i dont if I understand that well... can you email me to explain to me why they went to get you? ... only if you can ...thanks!
After I-130 you need to file form I-485(adjusment of status,permanent resident)$1,010.
After your approved on I-485 you should be able t work get an I.D/D.L , and your green card.

I dont know...depends on your case, my friend got her antorcha(its spanish,I dont know how its in english,this is a letter that allows you to do your I.D and SSC,and this comes with the work permit) 15 days after she filed... my aunt got her 3 months after she filed, so its depends on your case and your local immigration office.

Getting an approval for the I-130 is the easy part. When you apply for the I-485, it's a long, uphill battle--taking years in our case. Since you overstayed and ICE got involved, I would doubt your chances are very good for approval of your I-485. I hope you have an attorney? Once you file your I-485 with status pending, you can obtain a work permit until your case is decided. I hate to sound negative, but your case seems grim...you may well be deported. |
