How come, my grandmother who is 74 years old lives by herself, work her whole life. Husband served in WWII and she gets only $60.00 a month on Social Security? She doesn't' get a dime from the government for any aid. Can you live off of $60.00 a month? She also doesn't receive any pension form her husband that served in this country. Is that fair? And you are telling me that you came over here had "babies" just so they can be an "American Citizen" and receive Aide. I am sorry I have no respect for you. I have respect for people like my grandma, and thousands of people that are here that do not go thought the loop holes to get free aid.

The key to undoing the current misinterpretation of the Fourteenth Amendment is this odd phrase

"AND SUBJECT TO THE JURISDICTION THEREOF."

The whole problem is caused by the fact that the meaning of this phrase, which was clear to anyone versed in legal language in 1868, has slipped with changes in usage. Fortunately, there is a large group of court precedents that make clear what the phrase actually means:

The Fourteenth Amendment EXCLUDES the children of aliens. (The Slaughterhouse Cases (83 U.S. 36 (1873))

The Fourteenth Amendment draws a distinction between the children of aliens and children of citizens. (Minor v. Happersett (88 U.S. 162 (1874))

The phrase "subject to the jurisdiction" REQUIRES "Direct And Immediate ALLEGIENCE" to the United States, NOT just physical presence.
(Elk v. Wilkins 112 U.S. 94 (1884))

There is NO AUTOMATIC BIRTHRIGHT Citizenship in a particular case. (Wong Kim Ark Case, 169 U.S. 649 (1898))

The Supreme Court has NEVER confirmed birthright citizenship for the children of illegal aliens, temporary workers, and tourists.
(Plyler v. Doe, 457 U.S. 202, 211 n.10 (1982))

There are other cases referring to minor details of the question.

The so-called 14th amendment was never properly ratified either.
In the case of Dyett v. Turner, 439 P.2d 266, 270 (1968), the Utah Supreme Court recited numerous historical facts proving, beyond any shadow of a doubt, that the so-called 14th amendment was likewise a major fraud upon the American People.

Those facts, in many cases, were Acts of the several State Legislatures voting for or against that proposal to amend the U.S. Constitution. The Supreme Law Library has a collection of references detailing this major fraud.

The U.S. Constitution requires that constitutional amendments be ratified by three-fourths of the several States. As such, their Acts are governed by the Full Faith and Credit Clause in the U.S. Constitution. See Article IV, Section 1.

Judging by the sheer amount of litigation its various sections have generated, particularly Section 1, the so-called 14th amendment is one of the worst pieces of legislation ever written in American history.
The phrase â€œsubject to the jurisdiction of the United Statesâ€ is properly understood to mean â€œsubject to the municipal jurisdiction of Congress.â€

For this one reason alone, the Congressional Resolution proposing the so-called 14th amendment is provably vague and therefore unconstitutional. See 14 Stat. 358-359, Joint Resolution No. 48, June 16, 1866.

Nobody "deserves" government help. Let me tell you something. My county spends $9500 per year per child in the County-funded public schools. If you lived here, my County would be spending $40,000 PER YEAR just to educate your kids. Are you paying $40,000 per year in real estate taxes? I doubt it. Why do you expect the other taxpayers to subsidize your kids' educations?? Why don't you pay for their educations yourself?????

i agree with vampira and net and seether and centurion. i work for the government doing taxes and i'm sorry to say that you don't help any. legal or otherwise. there is something called refundable earned income credit that allows the person to get back ALL the money they paid to the government and then some. how does this help? honestly. why can't they go through the process of legalization instead of coming here illegaly and then demanding citzenship. and i hate to say this, but you can't be THAT bad off if you have a computer with which to ask all of these questions if you want to be an american citizen, then be an american citizen, be legal, speak english. english is now becoming a second language.

I will agree with one thing: that humans need to help one another. However, my feelings are said well as are many others to a previous question of yours. Your "lock" babies may have been born here, but you still should have come over her legally.

Illegal---Pay attention to the word....It means that in being here you are breaking the law....I don't blame you for wanting a better life for your children but you should have entered LEGALLY! Actually the laws are wrong in giving citizenship to your children. Citizenship shoul be a bithright but only if born to one or more US citizens. im on your side, we are all Gods children. i lived in Texas for 4 years back in the 80s and they had mexicans working with us and they are the best workers and really nice people too. i think americans are just jealous because mexicans are great workers and dont complain like we do.my husband has since died , but he spoke spanish and helped many families with getting jobs and such. these people have kids and want to have the best for them like we do so get off their backs and let them work....good luck

I am sooo with you, I understand why you can't change your country and why you can't work hard there. You can't work hard in your country because there aren't enough jobs, we Americans complain about how there aren't enough jobs here, well, there are less in Mexico. And you can't change your country because it's almost impossible. It's like adding a new amendment to the constitution, the states have to ratify it and 34 states have to approve it.
