ITIN number for my wife on H4 - Name to be used?

Hello All,
I recently got married and my wife is in US on H4 VISA. I am planning on applying for ITIN number and I have some questions with regard to the same.
1. My wife's name on passport and H4 VISA is lets say....
First Name: Sarah
Last Name: Verona
However on our marriage certificate her name is
First Name : Sarah
Last Name: King
Do I apply for ITIN number (name I should use in W7 or my 2008 tax return) based on my marriage certificate or the name she has on the passport or H4 VISA?
2. I recently applied for her SSN and got a denial letter - which I was expecting. I used the denial letter from SSN office to get a State ID. However, on the state ID and on the denial letter her name is "Sarah King" instead of "Sarah Verona".
Is this illegal? and should I get a new denial letter from SSN office with her passport name of Sarah Verona?
3. Does ITIN number request require a denial letter from SSN office?
4. What name should I used in W7 or my 2008 tax return - married filing joint - Sarah Verona or Sarah King?
Additional Details
5. Can I visit any local office of IRS to request for ITIN number? Any specific documents that are needed apart from passport, I94, VISA, insurance card, address proof and 2008 tax documents?

Use the name on her passport for everything. Yes, apply to SS office again and get a new state ID. You will have a lot of trouble with paperwork later on if her name on everything does not match. I would try and get the marriage certificate amended as well |

On what basis do you think your wife should have a SSN or ITIN? What is your status? US citizen? PR? Visa? Illegal alen? How did she get the H-4 visa? You? Father? Mother?
As an H-4 visa holder she is not allowed to work in the US. Nor can she get a SSN. She can get an ITIN for tax purposes.
I ask because if you were a US citizen then you could file for a AOS which would allow her to work, get an SSN etc.
If you are the H-1 visa holder she can not do the above.
Also what is her country of origin? How did he 2 names come about? Maiden vs. married?
For ITIN:
The IRS has revised it's list of documents acceptable as proof of identity and foreign status. An original and valid passport is the only document acceptable as proof of both identity and foreign status
Remember: If you submit an original valid passport (or a notarized or certified copy of a valid passport), you do not need to submit any other documents from the list below
If you do not provide your passport, you must submit a combination of (at least 2 or more) current and valid documents from the list below. These documents (or their combination) should verify
a) Your identity, i.e., contain your name & photograph
b) Support your claim of foreign status
National identification card (must show photo, name, current address, date of birth and expiration date)
U.S. driver's license
Civil birth certificate
Foreign driver's license
US state identification card
Foreign voter's registration card
US military identification card
Foreign military identification card
Visa
US Citizenship and Immigration Services (USCIS) photo identification
Medical records (dependents only)
School records (dependents and/or students only)
You can submit copies of original documents. Copies are not returned. These copies must either be - Certified by the issuing agency or official custodian of the original record OR Notarized by a US notary public
If you submit your original documents they will be returned. You need not provide a return envelope for this purpose. If your originals are not returned within 60 days call the IRS at the telephone assistance number. Keep a copy of your application for your records. To be on the safe side, mail your application by insured mail so that you receive a receipt. Avoid using originals if the copy can work. |
