I am going down there on a visitors Visa to Australia. I know someone down there he is an Australian citizen. If the 2 of us decide to get married while I am down there, what would need to be done and what would my requirements to be able to stay with my husband? Thank you in advance.

You will need to apply for a spouse visa with him as your sponsor. Just being married to him isn't enough though. You must prove to DIAC's satisfaction that yours is a genuine and continuing relationship and not one that has been entered into for you to gain 'back door' entry to Australia.
See the following booklet for information on spouse visas. Pay particular attention to the 'Evidence that your relationship is genuine' on page 39.

You can stay on a Tourist Visa in Australia for up to 12 months - provided that you specifiy to Australian immigration that you want to stay that long. However you will not be able to work in Australia on a tourist visa.
Once your in Australia you can file for a spouse visa. But to do this you need to be able to provide documentation that you have known each other for a long time - at least 2 years, that you have an on-going relationship, and that you are prepared to get married. You also have to show that you are medically ok and of good character.
The visa application could take up to 1 year - so be prepared for alot of chasing up paperwork, meetings with immigration etc. Your husband will also need to pay a 1,400 dollar fee for the visa application. |
