yes there is a waiver she can apply for but she has to have a clean criminal history.
You're getting a lot of silly answers here. First the ten year ban is after your second deportation. 8 USC 1325 EWI
Second she had no control over her parents actions as a child, but as an adult she must apply in a timely matter.
As stated she needs to see an immigration lawyer and apply for the waiver, she'll have to prove hardship ( ie i don't know anyone in Mexico or i don't speak Spanish) and she'll have to have a clean criminal history. |

unfair? what is unfair is that the rest of us have to pay to educate another illegal mouth to feed. that is unfair. |

My friend lived with his parents in the States since age of 4 went to college and worked here on wrk visa, now that his work visa is expired he went back to Canada. He and his family understand the law, they knew this is what was going to happen, so what makes her above the law? why would she be anymore deserving to stay? THE law is the law and should be no exceptions made |

No. She, like her parents, is 1 traffic stop away from deportation. The only option to legally immigrate is to go back to her own country and start from there. |

SORRY, but the child should hold the parents responsible for putting him/her into that situation. They should go back to their home country and apply to come here legally. They can go to college there while awaiting approval. Heck, with the excellent American education they got, they should be able to protest and turn their country into the best place to live in the world. It's an OPPORTUNITY to make their homeland a better place !!! |

Sure just make certain you're doing it in the country of your birth. Who ever said life is fair? |

your loving parents sealed your future by bringing you illegally in the USA,don't forget to say thank you !
nothing can be done now. |

she needs to go home along with all the rest of the illegals
i dont blame the people for wanting a better life but this country cannot afford to take this any longer its high time these illegals get out ! |
|

Wherever you go, there you are
 |
It may be unfair to you but thats life. The person would have to apply for legal status and get in line with everyone else |

Yeah but she is an adult now and you can't tell me it suddenly dawned on her one day, oh I am illegal. You should be asking her parents this question. With Mexicans into document fraud they can make anybody here brought as a child. That's why they call it fraud. |

unfortunately she has not much option. She is just like any other illegal alien in this country. |

She did not do anything wrong as a child, but once she turned 18 and became an adult, her immigration status became her choice. If she is over 18 and chooses to stay here illegally,it is now her decision and she can no longer blame her parents. She is now deportable with a 10 year ban on returning if caught.
Since someone living here illegally cannot change their status, her only option is to return to her home country and apply for entry legally. She will probably be banned on returning for 10 years because she chose to stay here illegally as an adult.
Her parents broke the law and knew the consequences of it. Putting the blame on the immigration laws as being unfair doesn't hold water. |

She is an illegal alien. The age at which she illegally entered the United States is irrelevant. She is eligible for deportation upon discover by US authorities.
Sorry, but that's the way it is. |

most children that came to the US as you did? do know that their parents speak another language at home, and therefore soon know where the family is from. you cannot say that you did know?.
you can ask my grand son where i am from? he will tell you in a second my original country and point on the map.
so? once you are an adult? you are responsible for your behavior, and you must do something about it.
until age 18 1/2 you can still return to your original country of birth and not be held responsible for your parents criminal activities.(yes it is called criminal activities) coming to the US illegally, sending you to school in the US,(without proper documentation) authorization,
US citizens pay for school and health care for other illegals as you.
well now you know that you are illegal? so do the right thing.
is it fair to me and others to continue to pay taxes for people like you?
what is fair in life?
citizens living by the rules? or you coming to the US disobeying the law immediately..and taking advantage of the system without having paid into the system? i doubt your parents pay annual taxes each year, why should they? they do not exist in the US...
nothing else to say to you. |

Once the child is an adult at 18 they have to go back to their own country and apply to come back legally. After that age they are subject to deportation at any time.
The only thing unfair is how she was treated by her parents in making her an illegal criminal alien. Her parents, no any one else. |

Well, the Supreme Being B. Hussein is pushing for amnesty for illegal immigrants. How ironic, B. Hussein has a birth certificate in Kenya and a false one in Hawaii. He's probably an illegal alien himself. So, the child can just sit around for a while untill they're given amnesty. Shoot all illegals! |

It might be wise for her to go to an immigration attorney. |

According to many here and law so far she/he has to go back to country of origin and wait in line-sometimes non existing line like in Mexico
I've already made a Question about native Americans wanted us all to be deported(we were brought here u know where by our ancestors) |

She can apply for legal status and hope she gets it.
She can leave the US and go back to her home country.
She can stay in the US illegally and hope no one catches her.
They likelihood of her getting legal status is probably very low. But she should apply as soon as possible, and if her parents/siblings have legal status then it should help her somewhat. |

I am sorry I can't really offer you an answer but I just want to say I hope that it all goes well for her because it is not fair to penalize her she had nothing to do with it and no choice in the matter. |
