Yes, you can do that. You can argue the Moon is made from Green Cheese also. The problem is that the judge can't make up the law as he goes along. The judge will require you to demonstrate, under the law, that you have a legal right to remain in the United States. There's no room for an emotional argument. If you can't convince the judge that you have a legal right to remain then you'll be order to leave.

If you violated immigration or other laws, you have no right to remain in a country whose laws you violate. It's your fault: you broke the law, and have been breaking laws continuously and repeatedly for years. Get out. Go home. There is no excuse for your lawbreaking.

You are not a citizen just because you had a child here,nor are there any special provisions for you because of it.
You can plead your case all you want. Might not do any good. You can still be deported for being here illegally for 20 years. A US born child will probably not help you unless the judge is very lenient. You are free to take your child back home with you.

No, that has been tried many times and does not work. The child is an American citizen, but you are not and cannot stay on that basis. When you are asked to leave, bring the child's birth certificate with you and he or she will be able to return as an adult.

but thats the problem with illegal aliens. They have anchor babies who allow the parents to stay because the babies are entitled to benefits and the illegal aliens take all they can and give NOTHING back.

You could qualify for creation of record if you were to go in front of an immigration judge. Of course, if you lost the case, you would be deported an banned for 10 years. Consult with an immigration attorney.

The laws are becoming more rigid now. I would speak to an international lawyer to plead your case but the law is rigid.

no. your child is a u.s. citizen. an immigration judge won't be necessary. his having been born here makes you a citizen as well. what you should do is apply to become a u.s. citizen. learn what it really means to be an american. become a part of what you came here to become a part of.

I'm pretty sure that once you give birth to a child in America that child is an American and you should be 'grandfathered' in according to some laws.
Of course being involved in any sort of crimes or being wanted in another country may override that... but those are pretty extreme conditions.

Hi, I dont think they are trying to be mean to her because she is not an american. Its because she came over without getting the proper paper work. Alot of people are just mad because our tax money is going to take care of illegal immigrants. We take care of them and they are doing nothing for this country, but to take away jobs.
