Well, in order for someone to petition for you they have to be able to prove that they can financially support you so that you won't become a charge of the state (receiver of welfare, etc.). Not sure about this one. However, if you marry someone with the sole purpose of gaining citizenship, that's considered fraud and you will be denied. If you are denied for fraud, you can never become a US citizen. I'd try a legal path. |

No, not likely. Marrying any American, regardless of whether they are in prison does not guarantee entry. Not only do you have to prove the relationship is sincere, but it also has to be proved that the non-US citizen will not be a financial burden on the country. That is, the US citizen has to prove they can financially look after you while you are not working. Since he is in prison he can not do that. |

No you will not get the legal permanent resident status (green card). The best thing will be to wait until your boyfriend/girlfriend leaves prison. |

Have you met this prisoner? (a requirement for a fiance visa/spousal visa is to have actually met in person)
How is a prisoner going to sponsor you?
How are they going to support you?
If you feel like wasting your time and money, go for it. I seriously doubt you would be approved.

There are two problems with this idea:
1. You must have met this person within the last 24 months. I suppose if you visit him in prison you could meet this requirement. But if you are just pen-pals and you have never met in person you will not be approved.
2. The U.S. citizen must show $18,212 of legal income to sponsor you. This is unlikely for a prisoner.

As per US immigration law you are eligible for green card if you get married to US citizen. It doesn't matter whether he is a prisoner or a criminal. But, it will be very difficult for a prisoner to file a petition for you and assure that he has enough to support you financially. So, I doubt if you will be able to get through. Will suggest you to consult experienced attorney in this matter

Very few prisons allow inmates to marry; and if for some reason a prisoner was granted permission, this would not go over well with immigration. I am almost certain they would deny you a green card or any other type of visa based on this 'union'. |

One question: Why in the world would you want to marry a prisoner? That's not the best way to try and get a green card. I'm pretty sure nobody can marry someone if they are in prison. That's just common sense. You should look into getting your green card in a safer and more secure way. |

Nope.
1. It would require a spousal visa which costs money and requires a residence in the US. His prison cell is not a residence that can be used and he being in prison does not meet the financial requirements to support you (even if he has the money it won't be counted)
2. To get married you both have to be present which you won't get to be w/o a green card already or w/o him escaping and then comming to you.
3. Also it will require proof of an ongoing relationship and your 2 seeing each other in last 2 years.
No chance. You'd likely be blacklisted for even trying to con the system. |

I hope so. I could marry an American jailbird chick when I'm older and get a greencard. I think if ou do marry a convicted fellon. Don't marry one on death row otherwise you will get caught out the cbp(customs and border protection) will ask a lot of questions like why marry someone who's gonna die you obviously want to get a green card etc....
So I say go for it but try one who is incarcerrated for a long time. You can marry legally by proxy. |
