I am an American citizen and he has been here for five years illegally. I know he has the ban but I need a way he can be here with me instead of the ban and wait.

If someone entered legally (with inspection) he can get married and adjust his status without leaving and getting a 10 years ban.
If someone hopped the fence and entered without inspection he will have to leave, get a 10 years ban and then after 10 years he could come back.
He has no ban at all since he entered on a tourist visa = legally. Even if he's overstayed he's ok.
First your get married , and them file for adjustment of status to a Green Card holder + you file for a SSN.
He could work within 3 months and get a green card in 6-8 months, thats very easy because he entered legally, if he entered illegally then its a completly different story. |

I've heard lots of cases where the illegal marries a citizen and then dumps her as soon as he becomes a citizen, just something to keep in mind. |

I assume he still has his passport and I-94.
Just get married. No trick to that.
After you're married YOU file I-130, I-864 and G-325A.
HE files I-485, I-131, I-765 and G-325A.
All of them get filed at the same time, in the same envelope. Total cost to file is $1,365.
He'll get a work permit in 60 to 90 days. He'll be interviewed for his Green Card in 6 to 8 months.
He can stay the entire time. HE MUST NOT LEAVE UNTIL THE (I-131 Travel Permit) PROCESS IS FINISHED or everything becomes void and your money is wasted.

He entered legally a visa and if he still has his i-94 HE CAN ADJUST in-country. HE DOES NOT HAVE TO LEAVE.
OH and he does not have to file a I-601 waiver, that waiver is for those that EWI or have a criminal record. |

Nope. After he returns to his own country, he can apply for your immigration to his country. There is no way you can "legalize" an illegal alien, even marriage. The sooner he returns to his own country, the sooner he can have you join him there, and the sooner his 10-year ban will be up. |

In addition to the regular forms, he must file I-601 Waiver for his overstay. And it is not something you can do it on your own. Hire a reputably competent immigration attorney. Good luck. |
