You'll never stop asking, right ?..
If you have the Visa, you're supposed to be there for short amount of time, until you both get married. He may then sponsor you for a Green Card, after you received your Green Card, you may wait 3 years to apply for U.S. citizenship. |

You are not allowed to enter the US on Visa Waiver, tourist visa or other visa while another application (like fiance visa) is pending. He will have to come visit you while the application is processed.
You and your bf both need to READ & STUDY the USCIS website info before you start applying. You can do this without an attorney, but you'd bloody well better read the instructions and follow them carefully. If you mess it up, you're done. While various people on Answers might know quite a bit, or give you a quick summary of a process, this is not the "official word from on high!" Now you need to get the word "straight from the horse's mouth," not just some friendly advice. |

See the site below for the procedure. When the petition is approved you will receive instructions from the US consulate/embassy as to
what is needed to obtain the visa. The procedure may take up to a year. You can apply for entry as a visitor before then but could be refused entry if it is conclued you are not a bona fide visitor.

First, your US Citizen boyfriend or fiance can only file Petition for you, by filing I-129F in US. Once it is approved, it will be forwarded to National Visa Center and your then fiance and you will be notified with instruction. Then YOU apply K1 Fiance visa at US Embassy in UK.
You can still go to visit him in US, but be honest about K1 Fiance process.

1.http://travel.state.gov/visa/immigrants/types/types_2994.html
2.They will ask you to come the embassy for the visa stamp. The visa restrictions say you must be married within the first 6 months from the time you have landed in the US.Where you will then have to apply for another visa CR-1.
3.Technically you could but maybe denied entry considering the visa process is still pending and having such a strong case of "immigrant intent" when the paperwork hasn't been finalized.
No.2 cont:If you should gain entry to the US with your approved visa you would have to do the following with your spouse.
"Who Qualifies:
Any U.S. Citizen in the United States with a Foreign National Spouse who entered the U.S. legally with a visa or a visa waiver. It is OK if the visa or I-94 has expired. Canadian Citizens do NOT need to show proof of entry (visa or visa waiver).
An Overview of the Process:
Once the marriage has taken place, the couple files the following with USCIS:
1. Petition for Alien Relative (USCIS Form I-130)
2. Application to Register Permanent Residence (USCIS Form I-485)
3. Biographic Information (USCIS Form G-325A)
4. Affidavit of Support (USCIS Form I-864)
5. Permission for Work Authorization (Optional) (USCIS Form I-765)
6. Medical Examination Results (USCIS Form I-693)
7. Request for Travel Documents (Optional) (USCIS Form I-131)
8. The appropriate supporting documents
9. The USCIS filing fees ($1,010 to $1,365).
The USCIS will contact you first regarding the Biometrics / Fingerprinting Appointment.
The USCIS will then issue the work authorization and permission to travel approximately 90 days after filing.
The USCIS will contact you next to schedule an interview. This will be anywhere from 6 months to 9 months after filing the initial application.
Following a successful interview, the foreign national spouse will receive a stamp classifying him/her as a Conditional Permanent Resident.
USCIS will mail the Permanent Resident Card (Green Card) approx 4-8 weeks after the successful interview.
The Conditional Status may be dropped by applying for Removal of Conditional Status (USCIS Form I-751) within 90 days of the 2 year anniversary of the granting of Conditional Permanent Residency." |
