Also if the ex-Husband & the Father wants nothing to do with child does the child get deported too from the U.K?. If the ex-Husband wants to see the child and pays maitenence does that help the Mother to get stay in the U.K. Basically what are the higher chances of the Mother staying in the U.K?
A) Father wanting the child and paying maintanence
B) or Father not wanting the child.

You depart or get deported. If the father does not want the child and if you get your baby a passport from your country of citizenship, take your baby and go back to your own country. If you are deported, baby will not go with you. You have no choice in the matter. You are not remaining, no matter what. So do you want to depart & take your baby, or get deported and lose your baby? |

You having a child in the UK has absolutely nothing to do with your immigration status. You will have to find your own means to stay in the UK if you don't want to leave.
A) If the father wants the child and pays maintainance, if you have joint custody with the father, you can not take the child out of the country without his permission in which case, the child stays in the UK with the father if you get deported. If you have sole custody, you may take the child with you.
B) If the father doesn't want the child, obviously the child goes with you if you are deported. |

Sounds like your 2 year spouse visa was only a ruse to get into the country so when it expires - out you go!

under the conditions of a further leave to remain visa you must leave the UK if the relationship has broken down, before your further leave to remain visa expires.
You can not obtain indefinate leave to remain unless you are still co habiting with your husband, and you will need proof of this if you apply for settlement ( ie indefinate leave to remain )
You will also ned permission from your ex husband should you wish to take the child out of the UK and this must be in the form of a written document |

As U.K allowed duel citizenship , you apply on home country passport for baby (if the baby with you order by court)than that were meet your plan and macth ex request.you were not deported cause by divorce,.,. |

What father does or does not want won't affect your status, having a child who might be a British citizen doesn't affect your status either, if you are here illegally you can either wait for them to start legal proceedings to deport you or go voluntarily
If Dad isn't paying maintenance I suggest you get onto the CSA or whatever it's called now
Stop wasting your time asking random strangers on the internet about your status & stick your hand in your pocket and speak to a solicitor specialising in immigration matters - this is your best chance of getting proper advice & improving your chances of staying in this country, if the solicitor can do nothing for you, he/she can at least look into the reciprocal agreements for child maintenance between your native country & the UK. |

If the child has UK citizenship, or even dual nationality,the child will have the right to stay in the UK. That means that the mother will also have the right to stay in the UK to look after the child, because if the mother was deported it would be impossible for the child to stay when he/she needs the mother to look after him/her.
The father wanting the child wouldn't have any impact on this unless he has full custody, in which case the mother wouldn't have the right to stay because the child can live in the UK without being dependant on her. |
