They have to apply for an adjustment of status, to become a permanent legal resident. You would need to sponsor them as their spouse. It's no easy task. ;) |

They would not have to return to their country unless their visa expired before a new visa was in place. I would consult with an immigration attorney. It is typically only an adjustment of status matter, but it still takes time and requires various fees. |

It depends on the visa.
A "B" visa and attempting to stay is prima facie evidence of visa fraud.
On the other hand if you had an F-1 visa you would be allowed to adjust status. |

I think they'd have to go back to their own country and then apply and be sponsored from there, married or not.
I'm not even sure if the marriage would be legal. Don't you have to be a US ciitizen to get married in the US? |
