i have a kid shes 4. and been with my boyfriend for 6 yrs i want to get married but dont want to take changes. i came here with my mom with a tourist visa and overstayed 11 yrs. what can i do to bout the citizen and where and who can i talk to about this? i need help so please help me? i can get a license or work.

If you received a tourist visa, and if the visa officer knew that your father was a U.S. citizen at the time of the application for the visa, the visa officer would have considered the possibility that you might be a U.S. citizen. If he knew about your father and still issued a tourist visa, it must have been the decision of the State Department that you did not acquire U.S. citizenship at the time of your birth.
If you were born out-of-wedlock to a U.S. father and an alien mother, a few things needed to happen before now. First of all, your father needed to legitimate or acknowledge you before age 18 under the laws of your residence. If that hasn't been done by now, it's too late.
There are four other requirements, but if you can't satisfy the first one, the other four don't need to be addressed. At this moment, you appear to be an illegal alien which means you're not allowed to work. |

Are you able to prove your father is a citizen? If so, that would help you. Otherwise, you probably need to contact the agency in your area that handles immigration. If you are here on an expired tourist visa, and you can't prove your citizenship via your dad, there will probably be a lot of steps involved. However, you should probably marry your boyfriend first. That will offer one more layer of security should anything go wrong. You do not have to prove citizenship to get married. |
