Immigrant visa refusal due to deportation case?

Hello everyone.
Has anyone have a similar experience or knows someone who has the same case? is there a way out of this or ways on how to reverse this decision. the consul said to file a waiver for the case but really do not have an idea on this waiver procedure. please help.

The consular officer had no choice but to turn him down based on his previous deportation. There's no way to reverse the decision, short of getting the immigration service to reverse the deportation, or declare they were wrong when they deported this person. The waiver route is the only way out. basically, you're asking the immigration service to forgive the deportation based on the extreme hardship the American citizen relative would experience if the applicant can't return to the US. So, you have to fill the waiver application out, and spend some quality time telling them exactly what sort of hardships would be experienced. More is better in these things and hope for the best while they're considering it. It can take up to six months for them to actually make a decision. If the waiver is granted, the visa will be granted and the person will be able to return and live legally in the US. |

They would most likely be talking about an 1-601 waiver, in which the sponsor needs to prove extreme hardship should the entry bar (caused by the previous illegal presence and deportation) not be lifted.
