my fiancee and i are living in Canada, i am Italian, she is American citizen. we plan to marry in a few months (either in Canada or in US and then come back here).
Is there a way for her to sponsor me EVEN IF SHE IS LIVING IN CANADA and one day go live in the US?
has anybody had the same experience? is it possible? if yes, how long does it take (assuming all the paperwork is correct)?
i already asked this question but nobody knew and..YES..i have already seen the official website, but i ask if somebody actually made it.
i hope there is a way, maybe through the US consulate abroad..

PS: how do we prove our intention to move? she has brothers and sisters there, but we can't have a house or properties until we actually move there..

After marriage, once you guys decide to move to US, if she has resident status in Canada, she can file Spouse immigrant visa for you at US Embassy in Canada. That is called Direct Consular Filing. You will present your bona fide marriage evidence along with I-130 form and get interview at the Embassy.

If she doesn't have resident status in Canada, then she has to come back to US alone and file Spouse visa for you. Unless you have resident status in Canada, you must go to US Embassy in Italy to get interview and visa approved.

The US citizen has to apply for a K1 visa for you before you get married. And you have to actually get married within 90 days of entering the USA. |

Yes, you can. First you need to have actual plans to move to the US (you can't just say that you want to eventually). Then you file through the embassy/consulate where you live.
You can prove your intentions to move with a job offer. They will not grant you permanent residency in the US if you are living in Canada. One can only have residency in one country at a time. For example, your American fiancé is not even a resident of the US since she is living in Canada. |
