If one is being held by the MI5/MI6 or the police at an airport when returning back to United Kingdom, for no reason and and freed.
Should one go thorugh the non EU passport line and and claim refuge or asylum from the authorities?
Remember each time this person is interrogated for no apparent reason for 3-4 hours.
The person who is interrogated is a UK citizen

A UK citizen entering UK (means homeland) can be stopped by UK Intelligence & can be asked anything by them. He has right to legal representation if he is accused of something, otherwise they have to release him & apparently they are releasing him so he cannot do anything.
He must have done something dodgy that's why his name appears on intelligence suspects list, or mistaken identity case.
If its mistaken identity, he should file a proper complaint with MI5/6 so next time he shouldn't be interrogated. |

They have a reason.
3 or 4 hours... not going to happen. And they tell you the reason. If a UK citizen you can ask for legal council before you say anything.
If MI5 or 6 had issues the person would not be freed. It would take far longer for them to arrive. |

Well, for a start you're not held by MI5/MI6 - it's the United Kingdom Border Agency (UKBA) - the Police only get involved if you need to be arrested or deported.
It may be that the person in question has very similar details to a known criminal, terrorist or other type of suspect, hence the questioning. Or that person is a suspect themselves.
If they are a British citizen they would not be eligible to claim refugee or asylum status when entering the UK. |

No UK citizen can claim refugee status or asylum. There must be SOME reason why this person is constantly questioned. Maybe he should speak with the Border Agency to find out why this keeps happening. Perhaps someone has committed identity fraud with his information and is wanted for criminal activity
I had a professor who was held by immigration in the US because someone had stolen his identity and was wanted by Interpol for money laundering. It was only sorted after 3 days when they finally figured out while the name and birthdate were the same, the physical description of the suspect was completely different. |
