Hello
My sister is getting married in India in summer. Her spouse is in US. I am also in US. Can I apply for a tourist visa for my sister before her wedding there and get her to US and can we apply for her I-130/K3 visa when she is in US in her tourist visa.
Will there be any legitimacy question in 130 processing as she is already in tourist visa? Has any of you done this before. Also we are not sure what are the chances of her getting the tourist visa approved as she is young and working in India.

Well, it's an intentional violation of US immigration law, but I imagine you already know that. From what you are saying, chances are pretty fair your sister will be turned down for the visa, as she should be considering it actually is her intention to immigrate to the US. You can't apply for the visa, she'll have to do that herself and take her chances. If it works, can she adjust status and become an immigrant here? It's possible if her husband to be is a US citizen, but it isn't possible if he isn't. Check out www.uscis.gov and check out the instruction sheet for the I-485 in the forms section and see for yourself. You should be aware that USCIS can turn this sort of thing down and force the applicant to leave to get an immigrant visa to return, It can go either way. |
