I started working for company X on EAD but the lawyer suggested if you want to bring your wife from India when u r working on EAD, it would be kindaa impossible. So, I asked my company to let me work on H1B. so now I working on H1 B. But now I am looking for another job. and since there are very few jobs on H1B. I was wondering if I can start working on EAD and then change to H1B. Is it okay? Won;t it create any problems legally and from marriage perspective. Please help.

How do you have your EAD? Do you have an Adjustment of Status pending? If so, then you could not bring a spouse here to the US unless she had independent nonimmigrant status. However, if you were in H-1B status, she could get H-4 once you are married. You can change back to H-1B from the EAD provided that your new job is a H-1B type position, and provided that you are eligible for more H-1B time. I recommend speaking with an immigration lawyer again about your options |
