Is our marriage will be consider legal or valid?

we are both filipino,we are married for 5yrs. and we have a baby..my hubby is a resident of usa and he works there..we got married here in phil..me and my baby still live here in phil. and my hubby come here 1-2x a year..last year my hubby said that he was married in usa but legally separated a long time ago (1997) and just got his divorce last year..ofcourse i got mad..we really love each other and our family are going very well..is our marriage here in phil legal or valid? will usa consider our marriage legal?
he is planning to petition me and our baby to be with him in usa..are going to have a problem? what should we do?

Your marriage is not valid because he was already married at the time he married you. You would have to marry him now since he is now legally divorced. This would have to be done before he can get you and the baby to the USA.

I think you should ask a lawyer. Off the top of my head, I would say your marriage is not valid, and you are with a very bad guy. I think he is playing you, I would be very careful about your future with him.
