I was on a J1 visa in the US for 2 years and now i am back in Australia. I was just wondering what the 2 year rule actually is. Does anyone know? I am wanting to go back on a J1 visa again.

It means you don't have to return to your country for 2 years before filing for an H, L or an immigrant visa, which is a requirement for some J programs. otherwise, if you're not applying for any of those, it doesn't affect you at all, either way. So, if you qualify for a J again, you can be issued the visa and go. |

the two year rule refers to marriages that are less than 2 years old when they apply.
if you have been married for more than 2 years when you apply for a green card, then you get the permanent green card straight away - NO conditions.
If you wish to go back to USA on a second J1 - visa with the SAME husband as the first J1 - then the 2 years rule does not apply do there are NO conditions becasue you are still maried to the same person.
BUT if you have divorced and are now married to a DIFFERENT husband from the first J1 visa, then the 2 years rule WILL apply only if you have been married for less than 2 years.
J1 visa is a spousal (MARRIAGE) visa - NOT the fiance visa. |

i was on j 1 visa in dec 2008 till dec 2009.then i came back,i m having 2 yrs rule,but i got my waiver certificate.so i wanted 2 know tht if i have waiver certificate can i again apply for j 1 visa again before that 2 yrs rule. |
