My husband and I got married 6months ago. we have a child together who is 18months old. we were together in ireland and had the baby there but he had to return to america to work and I came over on a holiday on the VWP and he asked me to marry him and we got married. my immigration lawyer wants to come to the interview with us but he is charging $500 to attend. we cant really afford him to come with the way everything is going with work. and i was wondering what does an immigration lawyer do at the interview and should we really need to bring him? thanks for all your help.

Normally, everything from the beginning to the end is included in the lawyer's fees (from filing the papers to the interview). You might want to review the contract you sign with your lawyer.
Now concerning his attendance at the interview, it is not mandatory but it helps a lot (but your interview should not be that hard view your story line). At the interview, the lawyer makes sure the immigr. officer doesn't cross any line or ask any out of line questions.
But if you feel comfortable enough, and especially cannot afford those extra $500, just pass and do your best at the interview.

What exactly do you need the lawyer to do that you can't? The best advice is to attend the interview like you would for a job. I really doubt you will need a lawyer but you will need to be focused and a true couple. If the lawyer is some sort of translator between the two then maybe scrape up the money. Ask the lawyer if he will help the two of you prepare for the interview by making sure you both know each other and have the right paper work (joint tax returns, bills,identification, love letters) In this economy though I would suggest saving it.

The lawyer will do nothing. The USCIS case officer may not even allow the lawyer to sit in on the meeting. |

i went to the imigration interview like 4week ago. i went with my husband thats it. the interview went great he did not even want to see the pictures. You do not need the lawyer there as long as your marriage is true on top of that you have a kid and i dont. Make sure you bring your joint accounts such as bank and insurance or something that you guys share. |

You know what my interview with my husband went fairly quick... about 10-15 waiting time and all. From my experience you don't need your lawyer there, if your relationship is for real and not just for papers then you guys should not have any problem. |
