Legal or illegal...if she files for support it will be based on his income. She will probably get less than she gets from him now.

He is not obligated to buy her a home or a car.

She is going to have to file for her status or be deported.

The problem is that if she is deported....her kid will go with her. That is going to be sad for all involved.

The UK passport can be renewed by sending in for a renewal at a US embassy. But if her card expired then the UK passport matters not.

There is only one solution........

You husband needs to explain why this is all happening....... for real, as it sounds like there is ten times more to this. How did she get a resident card in the first place? Even if she went to town legally she would have to file it in the courts. Then she would get "x' amount a month and at that point he could fight it. There would be no money for house or cars.

He could just get a lawyer now and be proactive. File for custody and for she not being able to leave the country with a child. This could be forwarded to the UK embassy easily.

It is really simple once your husband goes to it.

Your husband's ex lover can easily file for a renewal of her British passport via the mail. If she's extra spiteful she can also file for a passport for the child as the child is illegitimate the mother gets automatic custody under UK law and she can apply for it and take him back to the UK (the child is automatically British via Descent through her).

Your husband needs to be a man and set some ground rules with this woman. I suggest going to court and specifing what payments he should be making and in the process putting in a clause in the court orders stating that the child is not to be taken out of the country without BOTH parents' consent.

The fact that her alien resident card has expired doesn't necessarily mean her permanent resident status has expired. If she had conditional status that might well have expired, but do you have any idea how she got the card to begin with? As for her passport, she should be able to either renew it or apply for a new one at the British embassy. But, even if you were able to have her deported, what would become of the child? She might well take the boy back to the UK. Custody would be up to the courts, of course. However, as the parents were never married, it may well prove difficult for your husband to get custody, if that is your intent.

Report her (immigration status, fake Colorado drivers license (also, how do you know it's fake?)! The child is a citizen and try to get custody. Does your husband have legal visitation or custody? She's stringing both of you along and taking you for all that she can get. She's a mooch (not too mention an extortionist)!

tell her you are going to call INS and get cusatody of the child. yall are a more stable home for the kid. see what she does.. i bet she backs off. I think you should call a lawyer for some advice. its free! call em and see whats your legal rights!

The first mistake was something that cannot be changed, so that's a moot point. If she got pregnant on purpose, then so be it, that can't be changed either, but if you and your husband are supporting this woman 100%, if she is here illegally, then you and your husband can both be criminally charged as well for "harboring" an illegal alien and aiding in their ability to remain here, according to federal law. This must STOP.
Also, if you know that she is using falsified US documentation to continue to live here, REPORT HER. That is also a federal crime.
What is your recourse? Research the laws on child support, all your husband is required to do is pay out a certain amount of his income to her for the "care and wellbeing" of the child, not support her 100%, buy her a house, a car, etc. She is playing you. If she files for full custody in US courts, SHE will most likely be the loser, as the above is all that is required under the law. Plus, if she IS trying to extort money from you, which sounds very possible, then she is committing yet another federal crime. Talk to and find yourselves a good lawyer that specializes in custody disputes and one that specializes in immigration and go from there. Good luck

OK, some of what you said doesn't make sense. Not saying you are lying just maybe didn't explain it well.
Here is a solution, if that is what you are looking for.
You need to strike first. File for a custody order and have it served when you have the child. you will need to tell the judge everything that went on but I would think this is your husbands child there would be no problem your husband getting custody. After that, let nature take it's course. If she fights it, it will be found out that she is illegal and she will be deported. At best she will drop it and go back and get legal status and come back.
It is you and your husbands fault if she continues to jack you up. There is no way I would let an illegal take advantage of me that way.
Important. Get custody of the child first. You don't won't her splitting to God knows where with the kid.

If she has no home or vehicle; more than likely you and your hubby will get custody. Don't get milked by the loser and see an attorney. She is illegal also and can face fines for using fake IDs. The most important person is the son, not you or her. Get him taken care of without much drama, kids know.

She can not "fly into the US using a fake Colorado Driver's license" as she must have a passport to travel internationally. If the UK is issuing passports for illegal aliens, the problem is THERE. Let her file in the US courts and encourage your husband to grow a pair and testify that she is an illegal alien traveling on a fraudulent passport AND using a fraudulent driver's license. Those are both criminal offenses. She could very well go to prison prior to deportation. Also call ICE. You and your husband have let this situation go on and contributed to it by continuing to finance her. Stop it -- call Homeland Security today.

I UNDERSTAND YOUR FRUSTRATION! At least in my situation my US daughter has her child and doesn't share him, but no doubt the shit will soon hit the fan since he found someone else to marry him. weeks after being released from the deportion facility. nothing like teaching your child that it's ok to overstay your visa and lie to you mom about your status and do whatever it takes to get yourself legal at everyone else's expense. I think we need to allow more of this kind to stay- as if we don't have enough of our loosers already Be careful, she will find someone to marry her then you won't see the child at all. This man tried to use the child as a tool to get married. when that didn't work and he got picked up by ice, he just got his new girl to marry him.
