My Brother's I-130 petition was approved. What happens next?
Find answers to your legal question.

My Brother's I-130 petition was approved. What happens next?

My mom filed an I-130 petition (unmarried son/daughter over 21) for my brother who lives in El Salvador back in May of 2005 and we just received a notice a couple of days ago that it was approved.

1)What happens next?

2)The notice mentions that if we dont hear from them again in 90 days to contact NVC(National Visa Center). Does that mean he should be expecting an interview within the next 90 days???

3)What are those interviews like? Is there a 50/50 chance that he may or may not get approved for an immigrant visa like if he were applying for a travel/tourist visa???

-My mom has been a permanent resident for 20 years and has never had a criminal record.
-My brother has no criminal either.
-We are a total of 3 brothers. We all came from the same mom/dad(obviously) and all appear with the same last names.
-My grandfather was a commander for the salvadorian military(which has proven to be some sort of priveledge whenever my mom asks for documents at the salvadorian embassy).

Visit the department of state website, look under immigration visa for all your answers.
Next, the NVC will contact you and ask for other documents, just follow their instructions. If all your documents are in order and you send them right away, you should get an interview in about six months. There is little chance that he will be rejected unless he has a criminal record or something like that.

On the approval notice of I-130, he is given Priority Date (PD). He needs to check if his PD becomes on or before the cut off date by Department of State Visa Bulletin (VB). Only when his PD is on or before the date on VB, then he can file either immigrant visa at US Embassy in El Salvador.

As of April, only people whose PD is on or before September 2000 in Family Based 2B (Unmarried Sons and Daughters of Permanent Resident) can apply for immigrant visa.

Here is the link to VB.
