Spouse - If you are an American citizen you have two ways to bring your foreign spouse (husband or wife) to the United States to live. They are
Immigrant visa for a Spouse of a U.S. Citizen (IR1 or CR1) - An immigrant Petition for Alien Relative, Form I-130 is required.
Nonimmigrant visa for spouse (K-3) - It is important to note that application for the nonimmigrant visa for spouse (K-3) who married a U.S. citizen must be filed and the visa must be issued in the country where the marriage took place. After the visa process has been completed, and the visa is issued, the spouse can travel to the United States to wait for the processing of the immigrant visa case. Two petitions are required:
Petition for Alien Relative, Form 1-130; and
Petition for Alien Fiancé (e), Form I-129F
Fiancé(e) - If you are an American citizen, you may bring your fiancé(e) to the United States to marry; and live here.
Nonimmigrant visa for fiancé(e) (K-1)- To travel to the United States for marriage. An I-129F fiancé(e) petition is required. |

If I read your question correctly, then you want him to come back to the states legally. Ergo, he was here illegally the first time.
If that is the case, just make sure he was not deported or blacklisted. I say this because marrying him will not erase his record. He may not be admitted even if you sponsor him legally. Just make sure. |

You can choose to marry him in Mexico or bring him over here and get married. If you are going to get married in Mexico you will petition him thru K-3 (spouse visa) or CR1/IR1 (immigrant visa).If getting married here in the US will be more convenient to both of you, you can file for a K-1 visa petition.Both has almost the same timeline or processing period.It could take from 6 months to 2 years. Make sure that you send in complete packet of petition requirements to avoid delays.You can read for the requirements and download forms at www.uscis.gov.Good luck. |

Move to Mexico and marry him there, live with him there. How long is his bar -- 10 years or what? Even when he completes his bar and you can apply for his immigration, he is unlikely to obtain it if he has previously violated any immigration laws or been deported. If he has any criminal record, he is never returning to the US -- permanent bar to reentry. |
