Report the employer. Even if he is an illegal immigrant he is still entitled to get representation or a lawyer to collect the wages that is owed him. Under the law, he should still be paid even if he is an illegal immigrant.

Look for a pro bono (free) lawyer in your area and ask for help. Or give me the telephone number of the employer and I will make sure he pays up. I am not kidding! We should not tolerate people who take advantage of those who are in difficult situations.

Look for organizations in your area that are able to help. Start with free lawyers and give the employer a call to let him know that you will report him not only to the IRS and to the labor department. Not only will he face a lose of his business license, he will also be fined for hiring and taking advantage of cheap labor.

The law is clear on this issue (although not designed for this specific case) If he can not do the job legally, the person who hired him is not obliged to pay him. The law was set up to prevent unlicensed and unskilled people from doing work they shouldn't be doing.
ie. if I have a plumbers license in Texas and I did a job in Maine the person who hired me to do the job in Maine is not obliged to pay me because I was not legally able to do the job.
Your boyfriend, being illegal, was not able to do the job legally in this country and therefore is not entitled to compensation.

Very good you brought up this issue - let all see the honesty of Americans in their own country towards illegal immigrants. If not for those illegal immigrants all those legitimate businesses of rightful American Citizens would be gone long ago.
And I am very sorry about your bf - perhaps you can find another employer - the one he is working fro is just atypical scum bag made in USA.

Sadly! he's part of the millions of illegals that get treated this way, but I don't think there's much he can do. Have him contact an immigration lawyer near by and get some advice from him/her.
