Basically my brother in law made up a ssn 4 yrs ago and used that number to work. He entered the country legally but was not supposed to work. He has filed taxes every year he has worked using that number.
He is now married to my sister, is in the process of getting a green card and he received a real ssn along with a EAD. How should he file taxes this year?
Should he file married filling jointly? Separately? Should he file one tax return as single with the fake number and another one as married with the new number? Or is there some form to amend the previous tax returns with the fake number and change it to the real number? I also thought that maybe he can file using his new, real number and just include the w2's with the fake number since I heard that the numbers dont have to match (apparently the only thing the IRS cares is about getting their money).
Im trying to help him out bc I dont want my sister to get in trouble but I just dont know enough about this stuff.
I also know he has a ITIN number but for some reason never used it to file his taxes. He has been filing a 1040 by paper every year with the fake number.
I told him to stop using that number and use his own number from now on but I think that he will be in more trouble if he does not file something on that fake number which he earned income with.
Does anyone has any good advice on this?

He should file the taxes with his real SSN, now that he has one. Also, when he goes to the tax person, let him/her know the situation so they can transfer the SUI (social security tax withheld) from his previous pay checks to the new SSN. He might then be able to claim some of that money back and also that will count in the future (retirement, unemployment and stuff). Yes, he can stop using the fake one now and build something with his own! Plus,IRS cares less about immigration status.

Use the new number. IRS does not care about immigration status as long as you pay your income tax. You think IRS don't know you are using a fake SSN. They don't care as long as you file your tax. IRS would rather spend tax payer dollars to go after people/corporations for not filing multimillion dollar tax return than to go after a person using a fake SSN to file a $50,000 return. I am surprised that you even have to ask this question considering what you happening in the financial world. IRS now are going after people who make millions in bonuses and they don't care about small fries like us cause OB need us to pay tax to cover his Trillion Dollar spending. |

Oh c'mon people, you can't pretend he'll have to PAY taxes! You know darn well they're just trying to get in on every single one of those tax incentives where the gov't pays you for having too many dependents. They probably have 6 kids and will be getting sraight paid by the Feds for being here. Funny, I thought working with a fake SSN was fraud, and a crime (felony). You sign under penalty of perjury on your W-4, so whatever employer hired this person could also be in big trouble. Please, by all means, file your taxed dumbass, so everyone you know can get rolled up for hiring you in the first place! Have a nice trip back to Mexico sweety, that's where people like you belong. |
