I am not supposed to work any other job than computer job. I ran into 34,000.00 USD debt because I was relying on Credit cards to get by. What should I do now. He is not renewing my Visa and now he is asking to go back without paying credit cards. Please Advice.

Well to admit the truth,My employer is a freind of my friend who thought I would do well in the restaurant and hence opened up one. I was solo incharge of all the matters regading that restauant. But my pay was like 36,000 the first year and when I said it was not enough they generated like 50,000 the second went back to 40,000 and then again generated 50,000 the fourth time. Mean while I had to work 360 days a year no break except Easter,thanks giving,Newyear and Christmas. They promised the green card which they did file but has run into I140 denial. Which they appealed and filed another I140 with new Labor. Since they were trying to get Green card done they said they were spending on me. Now I sent my family back Last month and Now they say I have to leave too. My visa exprires Next month 2nd week. They did not pay me last month salary.

Well, you'd have to file a complaint through the Department of Labor since they're the only ones who have authority to deal with pay issues. Hard to say how long that would take though. more than a month, you can be sure. |

Did you have proper paperwork before you started the job with your employer.
If you and your employer signed a contract and you were not paid according to it, then you can easily get that money through court. The question which you might need to answer is that why you did not bring that earlier if you were not paid according to your contract. |

It sounds like your employer got your H-1 visa under fraudulent grounds. As your pay is far too low to be normally allowed for an H-1 visa and your profession is one where there is no shortage of qualified US workers. This is why your I-140 was denied.
As for your credit cards, you are really so far in over your head, that if you stayed in the US you would have to declare bankruptcy anyway.
The employer is supposed to pay your way back to your home country when the visa expires. It looks like you will have to pay that yourself. If you cannot, you may have to ask the US government to deport you. But really there is no way to stay in the USA with that debt over your head.
I would also suggest that because you were not even paid the promised salary that your visa was based on, that you also give a statement to US immigration so the employer cannot pull this sort of criminal behavior again. |

Contact US immigration you can call this no and get thier numbers and help at 1 800 fed info. That is illegal. File charges against him. Contact the US dept of labor as well so he cannot get anymore visa workers at www.dol.gov |
