He is american, i am english. We have decided we want to settle in America, how can i permanently live there once we are married? And how long could it take?

If you marry in the UK he will have to get a visa to allow the wedding to go ahead and will then have to go back to America without you to file for you to follow. You could marry him in America without any visa but you would have to go home alone after the wedding to wait while he files for your visa.
If you don't want to be separated after your marriage your best option is a K-1 (fiancee) visa as that will allow you to move to America, marry him, and stay while you adjust status and get a green card.
In any case he would first file a petition to allow you to apply for a visa. When his petition is approved it goes to your local Embassy, London for you, and they contact you with details of how you apply for your visa.
I used the guides in visa journey and asked a few questions in the forums there and got my K-1 visa 5 months after my now husband filed the first petition. It can take longer but can actually be a little faster. Visa Journey is a great source of up to date information with people posting their experiences as soon as they happen. |

Have him file for a K-1 visa, once approved you come here and get married within 90 days and file more paperwork. It can take up to a year. If he is living in England with you he can apply for a direct consular filing which is much faster. There are certain requirements though so check with the nearest Embassy or consulate. Good Luck! |

If you are not yet married, here are your options:
a) he can apply for a K-1 (fiancee) visa. Once approved, you can legally come to the US and get married.
-or-
b) get married, then he can apply for a K-3 (spouse) visa.
If you opt for the K-1 visa, it will probably take about a year to process (from last I heard). |

Some good answers below. As indicated below, your only option before you are married is the K1 fiance visa. Your U.S. Citizen fiance will have to apply for a K1 visa here in the U.S. If the petition is approved it will be forwarded to the U.S. Embassy nearest you (probably London.) There you will apply for a K1 fiance visa which is a non-immigrant single entery visa that allows you to enter the U.S. for the purpose of marrying your U.S. Citizen fiance within 90 days. Once you are married you must apply to adjust your status to that of a lawful permanent resident. I've provided some links below with more information on the process. Currently, the entire process takes about 12 months. (The K1 may be processed in about 6 months but by the time it is forwarded to the U.S. Embassy abroad and they schedule appointment for you and issue visa it will likely be about 12 months total.)
As mentioned below, if you were married your husband could file a simple immigrant visa petition. The processing time is about the same but there is less involved and you'd save about $1500 USD in filing fees. The K3 is also an option after you are married but the current processing times for the K3 are the same as the immigrant visa and the K3 costs much more so it is not worth it. Best of luck to you. |
