My friend(illegal Immigrant) wants to marry citizen?

she has to apply for a fiance visa from her home country

but she will likely not get it because she was illegaly in the country

i hope she gets banned for life ... it's cause of people like this!! sheez

Makes little difference because a illegal Immigrant can be deported even if married. Starting life as a criminal in the USA never works for the best. What makes her thing that she will be able to stay for permanent status. No way is she going to be able to stay in this country for 2 years to clear the sham marriage clauses, when she is already a criminal figuratively speaking.

She has to return anyway and wait to be petitioned by hubby

She should go back to her own country and have her legal b/f get her an f1 visa to come back.

She can be get married here and start the paper work while she is in here. If she came illegally she will have to pay a fine and go back to her home country to wait for her green card. If she came here legally, through some type of visa; student, tourist, etc. most likely she wont have to go back because originally she came here with a legal status, even if she over stayed her visa. Immigration laws are weird and sometimes complicated. She can get the right information she needs for her specific case by contacting USCIS.

She cannot apply PR STatus in US if she does not have any status currently. She must go back to her country and follow immigrant process at US Embassy. However, due to her illegal presence in US, she will face very difficult time getting approved. Every time she travels, departure and entry records are stamped on the passport.

Ok, first they need to get married and make sure that they both obtain a marriage license. Afterward, they need to file for the I-130 "Petition for Alien Relative." Then you need a copy of a birth certificate that is certified translated. Once the I-130 is approved you then want to fill out the G325A "Biographic Information.
