To your question about work and not being able to afford to not work, when you marry your girlfriend and she petitions for your residency, you may also apply for working status in the United States as soon as the United States Citzenship and Immigration Service acknowledges receipt of the 1-130 Petition for Alien Relative, usually within 30 days of receipt - it's very easy, actually, much easier than any other visa option. She simply has to apply for a K-1 fiancee visa on your behalf, which is required to move quickly by law. After your enter the States, you only have a short amount of time to marry and petition for residency. If you want to be with your child, and let's not forget your pregnant girlfriend, this is what you'll do.

You have four options and all of them involve marriage at some point. There is the K1 visa, the K3 visa the CR1 visa or her going to the UK.

The K1 visa is considered the quickest but that is sometimes not as quick as it should be and can take 4- 6 months or so. This is where she applies for fiance visa and you have 90 days to get married and you have to apply for work authorisation.

The K3 visa where you marry first and then come to the US for the rest of the processing but its takes longer than the K1 and again you have to apply separately fora work permit which is often not as timely as it should be.

The CR 1 visa where you marry and come to the US on a resident visa and can work immediately ,is supposed to be the longest of the three but the advantages and convenience can out weigh the time difference and frankly, there can be little time difference between this and the K3.

Or she can go to the UK on their version of the fiance visa which is by far the quickest and can be done in weeks. Not sure if she can even fly though if she is very pregnant or if she would even want to.

Now is actually a good time to apply. The UCSIS for some reason right now and I don't know why, are moving exceptionally fast and that might not last. It took only three months for me to get by them just recently for my parents and it often takes 6 months and thats before it has even gone to the NVC and it will probably be even quicker for the finace visas.

There is no real way round this, you are going to have some sort of separation unless you enter illegally and won't beable to work or she can go to the UK.

I have to say that if she is about to give birth, haven't you left all this a bit late?

Get married, the US doesn't have a "baby daddy" visa but we do have spouse visas. In any case, the child will be crawling before you get your visa and you cannot, legally, stay in the United States while it's being processed.

Get married and you can apply for a fiance/spouse visa for the US. Of course, she will need to prove that she can support you, unlikely, or get someone else to provide the guarantee (afidavit of support).
