My husband in American how do we move back there from Australia?

Hi, I am Australian so is our daughter, his son who lives with us here is American but they both have citizenship here, we are looking at maybe going to back Alaska where he is from how hard would it be for me to go there, we were told when our daughter was born that she is an American born abroad so does that have any bearing on it with me being her mother. Very confusing nothing is straight forward anymore.

Your daughter is American IF your husband filed the Consular Report of Birth Abroad with the US Embassy in Canberra or at one of the US Consulates down in Oz. If he did not file, she's not American, yet. So, that's the first thing he will need to take care of. Follow this link....

After that, it's very easy to get you a spouse visa to move with the family to Alaska. You will fall under the Immediate Relative category. You will get an IR-1 Visa.

Since your husband lives in Oz he can file directly with the embassy or consulate. This is called "Direct Consular Filing." It will save him months of processing time.

He needs to file I-130 and G-325A with the US embassy for you. The forms are here.....
