If you are being paid you do not indicate is it a weeks pay ? Two weeks ? Hiring a lawyer is very costly and they work to make money which means they will charge you lots of money to pursue this and this can run into thousands of dollars.

If you are in H1-B and not being paid, then technically you don't have a job. If you don't have a job, then you can't stay in H1-B status. Filing the WH4 won't necessarily get you the relief that you need. You might check the website www.shusterman.com to get some ideas about what you need to do, whom to contact, and how to proceed.
