No, an I-129 form would not be the right application. This form is used for H-1B's who are members of the professions, and nannies are not in that group.
The I-129 is used for agricultural workers and temporary non-agricultural workers. As domestic helper work is not of a temporary or seasonal nature, a domestic servant would not be an H-2B. Besides, you'd need labor certification to make someone an H-2B, and that is very unlikely.
An I-129 can also be used for industrial trainees. Obviously, a nanny isn't a trainee.
As the type of work would be of a permanent nature, you need to file form I-140 for an EW-3 worker. This classification also calls for a labor certification which you may find to be hard to get.
The process would be about 5 years. |

Yes, I-129 is the correct form. Your kids will be in graduate school before a visa becomes available. It's going to be a VERY long wait. |
