Hello, I entered the U.S. in 1995 with a R/L2 Visa that expired in 1996. The I-94 on my passport has a stamped admission date but no admitted until date. I found out recently that I had to update my over stay status but it's been years since my Visa and I-94 expired.
I am 19 years old now, and have alot of issues to deal with. I'm having a hard time finding a college that will accept an undocumented student, no financial aid help, out of state tuitions to pay if I get accepted, and very hard time trying to find a job because of my status.
I really need to figure my immigration problems out and the first step is to update my visa and i-94, which I've overstayed for about 13 years now. I checked into some websites but they only have information about what to do when either your visa or i-94 has expired recently but not when both have been expired for years now.
Can someone please help me out with what I should do or what I can do to begin my path of naturalization?
(On a side note, are there any possible ways I can get a temporary employment ssn so that I can save up some money for college?)
Please don't flame me with "GET OUT OF MY COUNTRY YOU ILLEGAL ALIEN!" type of comments. I know staying in the U.S. for all these years was wrong and I'm trying to sort this situation out. Comment like that which I've gotten plenty of in some of my other questions won't help me out much.

Judging from what you have said, there is no relief available to you. You are deportable pursuant to section 237(a)(1)(B), an overstay. It would not be that difficult for the government to show the court that you stayed longer than authorized.
If you leave the U.S., that will trigger a 10 year bar for having more than one year of unlawful presence. You are statutorily ineligible for any type of visa in your present condition.
Knowing that you are a deportable alien, the Social Security people aren't going to give you a temporary employment SS card. After all, you do not have permission to accept employment.
The reason that you're having a hard time now is because you're older, and things will not improve as you age. There is no hope for naturalization in that you are not a lawful permanent resident. There is no way for you to "update" your I-94. |

There is no way out of your situation without something negative happening to you.
If you go to any immigration office the law demands you be issued a notice to appear in a removal proceeding in immigration court. Nobody is going to issue a new visa to someone who has overstayed for 13 years. That is going to be a consequence for breaking the law, even while it was likely your parents fault. ICE and CIS can not just turn a blind eye to this kind of thing. That is why this country has laws, to keep people from abusing them and thankfully some are still enforced.
Your only hope is to return to your country and re-apply at the nearest US consulate for an immigrant visa and get on the waiting list. |

I dont know much about immigration. But you're only solution to your problem would be marrying a US Citizen. Since you entered legally you wouldn't have to leave the country. If you have your I-94 then youre good. If you marry a US Citizen, it will take you about 6 months to a year to get your green card. Try to marry a US citizen, but remember do it for love, not for the papers. I do now know of any other way to get you legalized. Consult a lawyer. Wish you the best. |

I was in your situation. the only thing you can do is marry a U.S citizen. I came here from canada in 2000 with my i94. Met a girl got married in 2006 and recieved my permanent greencard 2 years ago. You need your long form birth certificate; and as long as you haven't committed any crimes of moral turpetude you will have no problems. Im glad to say that im happily married and have a three year old son. Good luck I hope things work out with you. |
