Question about immigration to the US filing petition while in the us?

I'm in the US and am visiting my husband. I was going to return back to Canada at the end of next week. but I was wondering if anyone knew if I could stay here and have my husband file the I-130 petition and my I-485 adjustment to permanent resident status.
Is it legal for me to stay down here while we wait for the to process, or do I need to return to Canada

If you are a Canadian citizen you can remain in the USA for 6 months of every year with no visa at all. However, you are not permitted to work or claim any US social benefits while in the USA without a visa. That is, make sure you are still covered by Canadian medicare and have a travel insurance policy on top of that to cover you for the difference between US and Canadian costs.
