My parents petitioned for a green card for me using the F1 form in 2002 for an unmarried son and daughter of an US citizen and I waited for a long time and saw that there is no use anymore, and I gave up. In 2007 I got married and now I have a kid and all of a sudden they send me a paper that now I have an interview May 4th. Is it a problem now that I am married and how do I go around that? If I am in the process of getting a divorce will that also affect me getting accepted for a visa?

I haven't worked with an attorney to this point, why should I start now? I just need to know if I will get declined for the green card because the petition is for an unmarried son or daughter and now I'm married.

The classification on your visa can be converted from F1-1, the unmarried daughter of a U.S. citizen to F3-1, the married daughter of a U.S. citizen. The petition that your parent submitted in 2002 can still be used. There is no need for a new petition.
At this moment, the waiting period for an F3-1 visa is about two years longer than the wait for the F1-1, but if you still plan to move to the U.S., you should keep the appointment on May 4th.
Explain to the visa officer that you are now married and that you have a child. He can guide you through the process you will need to follow. Mention to him that you might get a divorce. The more information you provide, the better will be the answers. |

Best thing for you to do is 1st talk to a immigration attorney. Give your case to them clearly dont confuse yourself or them by giving at once so many details. |

Yes you will. By getting married you changed status from F1 to F4. Basically you will need to officially change your status to F4 and wait another 2 years.
