Should I summit a K1 visa before or after I visit America?

I am Canadian applying for a K1, however I am planning to visit America very soon. My application currently says I have not visited America (since I have not up until this point), but should I wait until after I visit to send in the forms,should it be alright to do it before I leave, OR would it be best to fill them out and submit them while I am visiting?

If you fill them out before you leave and they get into the system you may not be allowed into the US. As a person with a K-1 visa pending you are considered a definite "overstay risk"! If you are visiting "very soon" why not wait? |

You do NOT apply for anything.
Your AMERICAN fiance/fiancee is the one who submits the K-1 application (I-129F). The application should be 100% truthful at the time it's submitted. |

You cannot apply for a K-1. The American spouse has to apply for the K-1 visa. And as a Canadian, since you can legally visit the USA for up to six months a year, you can be in the USA while the paperwork goes through. However, you may have to go to a US consulate in Canada for interviews, etc.
Just do nothing to work in the USA until you get your employment authorization document.
But really, the best thing to do is to bite the bullet and pay the $1500 or so a professional immigration consultant will charge to handle all this to make sure everything is correct. |
