Ok so my dad married my step-mom 1 year ago, he had permission to be here in the U.S. So now he has the 2 year residence, but there's a huge problem my step-mom about 2 months ago she started doing drugs and now my dad can't controll her. I see my dad cry sometimes telling me he doesn't know what to do. So my question is what if my dad gets a divorce, how can he keep his residence? Or what should he do? I'd appreciate if someone gives me an advice! THANKS!

I can see why you're concerned and you have a reason for it. However, there are some options your dad can go for.
1. There is a waiver available for people on conditional green cards in case they divorce but they can prove they entered the marriage in good faith but it turned out bad out of their will and control.
2. He can stay married to your step-mom until his unconditional green card case is finalized.
Don't care about people who don't know what they are saying. You see, in your case, the US citizen spouse is the one who messed up the marriage and why would anyone have to pay for her mistake? It is a huge commitment for one to leave their country for another then when they settle down, various problems can arise out of their control. You guys should be more understanding... |

You should talk to a lawyer for some advice. Do a search on Yahoo.com; "immigration family law attorney + your city and state" or look for an immigration attorney on www.findlaw.com.

It is possible to remove conditions when divorced. He would need to apply for a waiver and would have to prove that the marriage was entered in to in good faith.
The divorce needs to be final before this can happen.
Has he looked in to perhaps getting her in to a rehab facility or counseling? |
