hi
i got married 2 and a half years ago to an american
i filed my papers 6 months later
i got everything ok with-en 6 months,fingerprint ss# work card
then i got the interview,after that another interview in 5 months,both of them i went to the uscis Office with my wife and everything was fine....
a year and one month from the application date, i got welcome to usa letter and that i should get my green card in 3-6 weeks
office nothing came in the mail so i called and they said my Application is in another of course where the green card is issued and they reopened ur case and u should get an answer within 6months,6 months passed and i asked again they said 90 days then another 60 days, till today the last waiting day...
i need to leave the country but of course i cant i need a Advance parole witch they can give but i cant come back because i staid some time illegal before applying.
i have been her for 2.5 years and i cant buy of advance in anything like a house or a car of a good job because i don't have my green-card yet and if u would ask my wife has a very bad credit that stinks to the moon
now im stock i cant leave to check on my work overseas because i cant come back and i cant just make my wive leave with me and leave all her family and friends...
so im thinking to sue them in federal court and make them make a decision.. any advice here plz.whats the chances in this case

This is a typical situation for someone who comes to this country and tries to adjust status.
I wish more people would read your story and reconsider any thoughts of getting married here and attempting to adjust status.
You admit that you overstayed. You violated the conditions of your admission as a nonimmigrant. You found someone to marry you. That person petitioned for you. You applied for adjustment of status long after your authorized stay expired.
Now you think that some court will have sympathy for you? You would either make the judge throw up or laugh out loud. Good luck!! |

You have most likely been denied BECAUSE you overstayed.
They just havent bothered to tell you.
I would leave ASAP and go home. |

Moe, It sounds like the USA is treating you like crap. If I were you, I would say "the hell with it" and move back to where you came from. This is obviously not working for you with all your bad luck. Maybe where you came from is better than here and it is your calling to return. |
