Sergio Lopez-Luna, 23, a Mexican citizen, admitted buying a fake Social Security card and permanent resident card for $250 in February 2004, when he entered the country illegally.

Lopez-Luna used the Social Security card to get work at a Clayton restaurant in April of 2004.

Lopez-Luna now faces up to six months in prison under federal sentencing guidelines and will be deported.

Lopez-Luna has been caught in the country twice and agreed to be removed rather than face deportation each time, prosecutors said. A cousin told the Post-Dispatch last year that he walks 24 hours through the desert to get back to the U.S., and send money home to support his wife and two daughters in his home city of Maravatio, about three hours northwest of Mexico City.

Lopez-Luna crashed the SUV into a sunken outdoor dining area of the restaurant Il Vicino on Sept. 18. One patron required hospitalization, and two others were treated at a hospital and released.

Lopez-Luna told the police that while making a left turn from westbound Maryland Avenue onto southbound Central Avenue, he was blinded by a bright light.

bottom line, anyone blinded by a bright light could have done the same, has nothing to do with his immigration status except that he will be imprisoned and deported. Accidents happen, its sad but true.

What does that mean. I just heard an American citizen killed his girlfriend and started eating her. Then he confessed all his crimes to the police. I believe this is worse.

Why do they continue to give him the 6 month first time offense? This is the punishment he should have gotten. Then this crash, because of a bright light might not have happened at all. Saving everyone the grief that continues to go on along with this kind of attitude, and behavior. Both from the courts, and the illegal who continues to do what ever he wants without real punishment.

a. The penalty for a first offense is up to six months in jail or prison and/or a fine of $50 to $250.

Continuous illegal entry requires this punishment.
b. The most serious charge is illegal re-entry returning to the U.S. after being deported. The penalty is as much as 20 years in prison for someone who also has a serious criminal conviction.

Through law we have made provisions for legal immigration into our country. Those electing to not comply with these laws commit crimes when they slip into our country and continue to compound that crime every day they remain here. As time changes laws also need to be changed. But until the law changes they continue to be the law. We need to rewrite the laws making the immigration process more streamlined and allowing a reasonable number of legal immigrants into our country. Those laws also need to be more stringent in the apprehension and deportation of illegal aliens and in prosecuting American employers and officials who entice the illegals to come here. We maintain our freedom through the enactment of laws that protect society; our immigration laws are a part of our freedom that will rapidly deteriorate if we turn our back on the illegal alien problem! Those who illegally enter our country are crimnals and need to be treated as such.
