Not even a legal immigrant can marry a US Citizen and becomes automatically a US Citizen. You don't even get automatically a Green Card. Anything that is related to Immigration has to be sent to USCIS and be approved. You can apply for citizenship under the 3 Year marriage rule but you have to provide a lot of documentation that you and your spouse live together and such. Basically prove that your marriage is legit.

Marriage to a US Citizen grants no automatic rights to residency or citizenship.
They need to have their spouse sponsor them for residency and if approved they can apply for citizenship 3-5 years after receiving their green card. |

They adjust from being a visa holder to green card status, which eventually leads to citizenship. In order to adjust your status you must currently be in a legal status. If you are here illegally you have no legal status to adjust from, so you are not allowed to change your status. The person here illegally must return to their home country and apply for a spouse of a US Citizen Visa. |

First, there is no such thing as an illegal "immigrant." All immigrants are by definition are inside of America legally. The correct word, by legal definition, is illegal ALIEN. So you premise is false.
If an illegal ALIEN marries an American citizen then the American citizen is now a criminal. They are aiding and abetting a felon. Which is a felony. So the answer is false. |
