these are two different issues. One is immigration and the other is family court. Did she ever get her green card, just because you married her doesn't make her legal, she had to fill out an application and get approved.

Oh My God! Is this really the relationship you would like your child to have to you - one where their WHOLE LIFE they know you sent mommy away? I'm telling you that is the stuff that decades, heck lifetimes of therapy, pain, unhealthy relationships, and heartache are made of!!! You do not want to do that to your child.

Plus, if you get the right court judge, he may say she needs to take her child with her, even if the baby was born here. There have been cases in recent years where they deport baby (or infant, toddler, teenager) even if they are a citizen along with the mother!

First try talking to the mother about seeing the child and attempt all possible avenues of discussion. Then if she is still resistant - and you have no history of violence, drug use, etc... - then don't tell her, but consult an attorney about getting rights to visit.

Please, just don't try to sweep the baby away from its mother! It won't end well for anyone.

Exercise your rights as a father and take her to court for custody or visitation,perhaps her immigration status will be brought up. She has no right to keep your child away from you.
She did not become legal just because you married her unless you have filled out all the paperwork. If you haven't,her status is illegal. Marriage to a citizen does not automatically grant status to the spouse.

Yes you can, but you may not be able to see your baby straight to his eyes becaise you will know you are a shame and a judas, why would you take that baby away from the mother, that baby needs his mother more than it needs you. ***---hole

If you are in America and the baby was born in America, then she is legal now. Also, the fact that you and her were married makes her eligible to be a naturalized citizen. If she hasn't applied for naturalization, then when you turn her in, they will tell her to.

If you are legal and she's your legal spouse, she is legal as well. Assuming however, there is a provision I'm not aware of and she IS illegal - the courts try to keep children with their parents. So if she were jailed/deported, odds are you would be awarded custody.
